The Trần Văn Thêm Wrongful Conviction

The 1970 attack

In July 1970, Trần Văn Thêm and his cousin Nguyễn Khắc Văn were traveling in northern Vietnam when they stopped for the night near Diện Bridge in what was then Vĩnh Phú Province. Reliable retrospective reporting describes an assailant entering the roadside shelter where they were resting and attacking both men during a robbery.

Văn suffered a severe head injury and died. Thêm was also injured, but investigators came to suspect him of killing his cousin for money rather than treating him only as a surviving victim of the attack.

Two death sentences

The Vĩnh Phú provincial court convicted Thêm of murder and robbery in 1973 and sentenced him to death. In 1974, the Supreme People's Court upheld the conviction and death sentence on appeal.

Thêm continued to insist that he and Văn had both been attacked by a robber. The case later became one of Vietnam's most prominent examples of a miscarriage of justice.

Another man confesses

In 1975, another prisoner confessed to killing Văn and injuring Thêm. Reliable Vietnamese reports render that prisoner's name inconsistently in English-language transliteration, so this page does not force a single spelling where the source record conflicts.

Thêm was released on December 27, 1975, after more than five years in custody. His release, however, did not immediately produce the formal legal declaration of innocence that he and his family sought.

Decades seeking formal exoneration

For decades after his release, Thêm petitioned courts and other authorities to clear his name. In 2015, the Supreme People's Court received a renewed appeal, and the matter was again reviewed by central judicial agencies.

In August 2016, authorities announced a decision ending the investigation against Thêm and publicly apologized for the wrongful prosecution and convictions. State media reported that the decision formally established that he had not committed the killing for which he had been sentenced to death.

Compensation

The legal aftermath continued after the apology. In 2019, the Supreme People's Court paid Thêm approximately VND6.7 billion in compensation for the wrongful imprisonment and the decades during which the conviction remained attached to his name.
