The Murder of T. Nhaveen

The attack and Nhaveen's death

In June 2017, T. Nhaveen and his friend T. Previin were involved in a violent confrontation in Bukit Gelugor, Penang. Contemporary police reporting stated that Nhaveen was found with catastrophic injuries and was admitted to Penang Hospital. He died on June 15, six days after the alleged attack.

After his death, Malaysia's Inspector-General of Police announced that the investigation had been reclassified as murder. Public reporting described Nhaveen as a teenager who had previously experienced bullying. Because the available coverage includes disturbing allegations about the manner of the assault, this file does not reproduce graphic detail that is unnecessary to understand the criminal proceedings.

The five defendants

Five people eventually faced murder proceedings: S. Gopinaath, J. Ragesuthan, S. Gokulan and two other defendants who had been juveniles at the time of the incident. The charge alleged that Nhaveen was murdered at a park in Jalan Bunga Raya between about 11 p.m. and midnight on June 9, 2017. Some of the defendants were also charged in connection with injuries to Previin.

The fact that someone was charged does not establish guilt. That distinction became especially important in this case because the High Court initially found that the prosecution had not made out a sufficient case requiring the defendants to present a defence.

2023 High Court acquittals

On October 3, 2023, the Penang High Court acquitted and discharged all five defendants without calling for their defence. Contemporary court reporting recorded that the prosecution had failed at the prima facie stage. At that point, all five stood acquitted.

The prosecution appealed. An appeal against an acquittal is not itself proof of guilt; it asks an appellate court to review whether the lower court applied the law and evidence correctly.

2025 Court of Appeal ruling

On January 13, 2025, Malaysia's Court of Appeal reached a split result among the five accused. It overturned the acquittals of Ragesuthan, Gokulan and the two defendants who had been juveniles at the time, finding that the prosecution had established a prima facie case against them. The panel ordered the four to enter their defence and sent the matter back to the Penang High Court.

At the same time, the Court of Appeal upheld the acquittal of S. Gopinaath. The appellate panel found that the prosecution had not established a prima facie case against him and noted prejudice arising from the fact that he had been charged years after proceedings were already under way.

Federal Court proceedings concerning Gopinaath

The prosecution attempted to take Gopinaath's acquittal to the Federal Court. In June 2026, however, the Federal Court struck out the prosecution's appeal after repeated difficulties serving the notice of appeal. The practical result is that Gopinaath's acquittal remains intact.

This outcome must not be conflated with the position of the other four defendants. Their acquittals had already been overturned by the Court of Appeal, and their cases were remitted for them to present their defence.

The retrial remains active in 2026

After delays connected in part to the Federal Court proceedings, the Penang High Court set new dates for the four remaining defendants to continue their defence. On July 3, 2026, Malaysian reporting stated that trial dates had been fixed for October 7–9 and October 12–16, 2026.

Those dates were still in the future when this file was last reviewed on August 30, 2026. Accordingly, it would be inaccurate to call the four men convicted, acquitted, or finally exonerated. Their status is that of accused persons whose High Court acquittals were overturned and who were ordered to answer the prosecution case.

Current status

The case is classified as unsolved / active proceedings. Nhaveen's death is a documented homicide case, but criminal responsibility is not finally adjudicated for the four defendants whose acquittals were reversed. Gopinaath remains acquitted. The archive will require an update after the resumed Penang High Court proceedings or any later appeal.
