What happened in Quito

Martha attended a birthday gathering at a bar-restaurant in the Jipijapa sector of northern Quito. When the owner and two women temporarily left the premises, she remained with three men. On their return, they found her unconscious and showing signs of severe violence, and she was taken for medical treatment.

Police detained the three men on the day of the assault and transferred them to the flagrancy unit. Prosecutors charged Juan Andrés M. and brothers Jhon Alexander and Danny Paúl C. The use of initials here follows the official Fiscalía record and avoids publishing more identifying information than the primary source.

Evidence and prosecution

The Fiscalía presented a substantial evidentiary record. Its official chronology lists thirty-three witnesses, Martha's advance testimony in a Gesell interview room, medical and psychological examinations, biological and other forensic analyses, and extraction of images from mobile phones.

Investigators also linked biological profiles to items recovered at the scene and used facial-comparison analysis on images from the defendants' phones. A fourth person was initially linked to the investigation, but prosecutors declined to accuse that person. This page therefore does not include him among the convicted perpetrators.

The August 2019 judgment

After a reserved trial required by the nature of the offense, the Tribunal de Garantías Penales announced its decision on August 27, 2019. Juan Andrés M. A., Danny Paúl C. and Jhon Alexander P. C. were each sentenced to 29 years and four months in prison as perpetrators of rape committed as a group.

The court also ordered each convicted man to pay US$10,000 in comprehensive reparation, imposed the reported statutory fine and ordered psychological treatment for Martha. The Fiscalía states that the aggravated sentence applied the rape provisions of Article 171 of Ecuador's criminal code together with aggravating circumstances.

Current status and limits of the record

The criminal responsibility of the three defendants was adjudicated in the documented 2019 judgment.
