A disappearance after a relationship ended
Kerry Winter was a 36-year-old South African events executive living in Dubai. Contemporary court reporting described Mark Arnold as her former boyfriend. Their long-term relationship had ended months before she disappeared. On the evening of August 20, 2008, Winter was last heard from after contacting a friend while Arnold was in the same general area.
Winter did not return home and her disappearance prompted a broad search involving relatives, local authorities and public appeals. Her body was never found. That fact remained central throughout the criminal case because the prosecution had to prove a homicide without recovering the victim.
Investigation and arrest
Witness testimony and the parties' movements became important parts of the prosecution. Reporting on the later trial said neighbours described seeing Arnold assault Winter outside her residence before she was taken away in a vehicle. Arnold left the United Arab Emirates after Winter disappeared and was arrested when he returned to Dubai several days later.
Arnold acknowledged assaulting Winter during the events surrounding her disappearance but denied murdering her. During the litigation he also argued that statements attributed to him had been coerced and maintained that investigators had ignored evidence favourable to the defence. Those assertions were presented to the courts and are recorded here as defence claims, not as findings that the conviction was invalid.
A murder case without a recovered body
The prosecution advanced the position that Winter had been killed and that her body was disposed of after the assault. Court reporting recorded more than one account of where the body might have been taken. Because the body was never recovered, Crime by Region does not state an unverified disposal location as an independently established physical fact.
The supported legal conclusion is narrower and stronger: the Dubai criminal courts found the evidence sufficient to convict Arnold of murder even without a body. No separate page is created for speculative theories about the missing remains, because they belong to the same single homicide case.
First-instance conviction
On June 7, 2010, the Dubai Criminal Court of First Instance convicted Arnold of murdering Winter and sentenced him to 15 years in prison followed by deportation. Contemporary reporting noted that both the defence and prosecution retained appeal rights.
The conviction did not end the case. The prosecution sought a more severe sentence, while Arnold continued to challenge the guilty verdict and the handling of the investigation.
The sentence becomes life imprisonment
On December 19, 2010, the Dubai Court of Appeals increased the punishment from 15 years to life imprisonment, described in contemporary UAE reporting as a 25-year term. Arnold then took a final appeal to the Court of Cassation.
During the Cassation proceedings, the court said the case did not establish premeditation. That did not result in an acquittal. The core murder conviction remained before the court, while the defence continued to argue evidentiary and procedural errors.
Final Court of Cassation ruling
On February 7, 2011, Dubai's Court of Cassation upheld Arnold's life sentence. The National reported that the ruling brought the criminal appeal process to an end and that Arnold had no further avenues of appeal in the case. The final outcome therefore supports classification as Solved / Adjudicated.
The final judgment does not erase the fact that Arnold maintained his innocence. A responsible case file can record both propositions at once: the defendant disputed the prosecution's account, and the courts ultimately entered and upheld a murder conviction.
The unresolved question of Kerry's remains
The criminal responsibility question reached a final judicial outcome, but one deeply important question remained for Winter's family: her body was never recovered. After the final appeal, relatives continued to seek information about where her remains had been left. Later civil proceedings also addressed compensation for the family.
That distinction is why this archive does not label the homicide “unsolved.” The location of the remains is unresolved; the murder conviction itself is final.
