Daniel Tupý and the night of the attack
Daniel Tupý was a 21-year-old student at the Faculty of Arts of Comenius University. On the evening of 4 November 2005, he was walking with friends in a park along Tyršovo nábrežie on the Petržalka side of the Danube.
A group approached and attacked the students. Contemporary and anniversary reporting described knives and knuckle-dusters among the weapons. Tupý was fatally wounded. Six other people were injured, one seriously. The sudden group assault and later investigative controversy made the case one of Slovakia’s most prominent unresolved murders.
Competing theories, no final finding
The crime prompted public demonstrations against violence and extremism. Investigators initially explored a neo-Nazi connection, and the case has remained associated in public memory with extremist violence. Police also worked with a separate theory involving organized-crime figures.
No final judgment has established which theory explains the attack. The archive therefore does not present ideology, underworld rivalry or any other motive as proven. The only safe conclusion is that Tupý and his friends were attacked by a group and the complete responsibility record remains contested.
The first prosecution and 2009 acquittals
Authorities brought an earlier case against five people. In June 2009, the Bratislava I District Court acquitted all five. Those acquittals matter: the people cleared in that proceeding cannot be converted into perpetrators merely because they were once charged.
After the failed prosecution, criminal proceedings were interrupted for approximately eleven years. The long gap complicated witness memory, evidence assessment and confidence that the case would ever reach a reliable conclusion.
The reopened investigation
Police reopened the case, and in 2023 authorities charged lawyer Adam Puškár with murder. Prosecutors alleged that he participated in the group attack and fatally wounded Tupý. Puškár denied the allegation and has maintained that he is innocent.
The proceeding against him is distinct from the 2009 case. The earlier acquittals do not prove the new allegation, and the new charge does not reverse the acquittals. Each defendant’s position and each body of evidence must be assessed separately.
The 2023–2026 trial
The trial began before Bratislava City Court I in November 2023. Hearings continued through 2025 with testimony from people who were present near the riverbank, members of the social group under scrutiny and witnesses addressing the history of the investigation.
Several witnesses declined to testify in May 2025, citing the risk of criminal prosecution. Later testimony included competing accounts of who was present and what was said after the attack. These statements are evidence for the court to assess, not a basis for this archive to decide guilt.
Delays and the current status
In June 2026, a hearing could not secure the attendance of protected witnesses or a separate criminal file sought by the court. Only one witness was heard. The record illustrates practical obstacles still affecting the case more than twenty years after the murder.
A September 2026 hearing was cancelled because a substitute judge was unavailable. Court spokesperson reporting said the proceeding was rescheduled for 6 November 2026 and police were expected to secure two protected witnesses. As of 1 October, there was no verified verdict in the current trial.
The family’s search for accountability
Daniel Tupý’s father has repeatedly attended proceedings and spoken publicly about the family’s loss of faith in the justice system. His statements are part of the public record but do not determine guilt. They explain the human cost of two decades of failed or incomplete proceedings.
The case also became part of Slovakia’s broader debate about extremist violence, police integrity and prosecutorial independence. Those systemic questions remain relevant, but the page keeps the focus on Daniel, the other injured students and the evidence tested in court.
Why the case remains unresolved
A resolved classification would require either a reliable final judgment establishing responsibility or an authoritative closure explaining why no prosecution can continue. Neither endpoint had been reached. The first prosecution ended in acquittals, while the current defendant’s trial remained active.
The archive will update the page if the Bratislava court enters a verdict and any appeal is resolved. Until then, Puškár remains an accused person entitled to the presumption of innocence.
